  1. REVOLUTION LICENSE AGREEMENT AND WARRANTY DISCLAIMER
  2.  
  3. License for Revolution software and all associated files, including 
  4. installer archive and all related documentation ("Revolution Software")
  5.  
  6. IMPORTANT -- READ CAREFULLY: By using the Revolution Software; or if 
  7. applicable, by clicking the "I Agree" button in the installer archive or 
  8. Revolution Software, you agree to be and are hereby bound by the terms of 
  9. this License Agreement  ("Agreement"). If you do not accept the terms of 
  10. this License Agreement: (if applicable) you must not press the "I Agree" 
  11. button in the installer archive or Revolution Software; you must not use the 
  12. Revolution Software; and you must immediately destroy all copies of the 
  13. Revolution Software, including the installer archive and any copies of it.
  14.  
  15. 1.    GRANT OF LICENSE:
  16.  
  17. a)    Runtime Revolution Limited hereby grant you a non-exclusive 
  18. non-transferable license to use the Revolution Software subject to the terms 
  19. set out in this Agreement:
  20.  
  21. 2.    THE FREE EDITION
  22.  
  23. a)    The Revolution Software is provided without an enabling licensing key 
  24. ("Free Edition").
  25.  
  26. b)    You may use the Free Edition on any supported platform to build 
  27. stacks, applications or files for your own use or to give to others either 
  28. free of charge or for a fee ("Created Software").  You may distribute your 
  29. Created Software by any method to anyone, subject to the terms of this 
  30. agreement.
  31.  
  32. c)    The Free Edition has limitations on the number of lines of script that 
  33. can be attached to a single object in the Revolution Software ("Script 
  34. Limits"). These restrictions may be varied at any time without notice. You 
  35. may not attempt to exceed the Script Limits. The Created Software must not 
  36. allow users to exceed the Script Limits.  Additionally, the Free Edition has 
  37. limits on the type of external databases it can access ("Database Limits"). 
  38. These restrictions may be varied at any time without notice.  You may not 
  39. attempt to exceed the Database Limits. The Created Software must not allow 
  40. users to exceed the Database Limits. 
  41.  
  42. d)    Copyright notices, as defined in Appendix A, must appear wherever any 
  43. other copyright or trademark notice appears in any Created Software, its 
  44. documentation, advertising, and other product-related literature.
  45.  
  46. e)    Certain files included with the Revolution Software are subject to 
  47. special restrictions.  These include any files not initially distributed in 
  48. the "components" directory, including the "Revolution" or "Revolution.exe" 
  49. application program, "license.rev" file, installer archive, read me files, 
  50. and also the "licensing.rev" file, and all compiled (non Revolution stack 
  51. file format) files from inside the "components" directory ("Restricted 
  52. Files").  You may not modify, translate, reverse engineer, decompile, 
  53. disassemble or create derivative works based upon these Restricted Files.  
  54. You may however use the "Distribution Builder" in its original unmodified 
  55. form to include these files (with the exception of license.rev) in Created 
  56. Software.  This paragraph does not apply to any of the other files included 
  57. with the Revolution Software, which may be modified freely, though all files 
  58. in the Revolution Software must be used subject to all other provisions in 
  59. this agreement.
  60.  
  61. f)    You may not resell, rent, lease or otherwise transfer rights to the 
  62. Free Edition for any financial gain or remove any proprietory notices or  
  63. labels on the Free Edition.
  64.  
  65. g)    You must not at any time during the period of this License create or 
  66. distribute Created Software to be used as a generic rapid application 
  67. development tool in circumstances which Runtime Revolution Limited considers 
  68. will have an appreciable adverse effect on the sales of Revolution Software.  
  69. This clause is intended to prevent you from using the Revolution Software to 
  70. produce something that is damaging to our business.  In the event that 
  71. either you or Runtime Revolution Limited determines that your software is in 
  72. such competition, you must withdraw the Created Software immediately.  It is 
  73. agreed that producing software that is in competition with the Revolution 
  74. product could cause irreparable harm and injury and Runtime Revolution 
  75. Limited will be entitled, in addition to any other rights and remedies it 
  76. may have at law or in equity, to an interdict, injuction or other similar 
  77. relief injoining or  restraining you from doing or continuing to distribute 
  78. such Created Software.

  81. h) Runtime Revolution Ltd offer a number of custom options including 
  82. training, enhanced technical support arrangements, product customization and 
  83. more.  Some of these options may be purchased separately, and some may be 
  84. available with a custom Installation License.  The terms of a custom 
  85. Installation License supersede the terms of this license agreement.  Contact 
  86. us to discuss your requirements.
  87.  
  88. i)    As per United States law, you must not distribute any portion of the 
  89. Revolution Software or Created Software to Libya, Cuba, Cambodia, North 
  90. Korea, Vietnam, and military and police entities in South Africa. Revolution 
  91. has been classified under U.S. Export Control Commodity Number  (ECCN) 4D96G 
  92. and can be exported under the provisions of General License G-DEST.
  93.  
  94. 3.    THE 30 DAY TRIAL EDITION
  95.  
  96. a)    You may request a key to upgrade the Free Edition to the 30 Day Trial 
  97. Edition ("Trial Edition") for free.
  98.  
  99. b)    You may use the Trial Edition strictly for evaluation purposes only.  
  100. Unlike the Free Edition (above) and the Licensed Editions (below) you may 
  101. NOT distribute software created with this edition for free, commercially, or 
  102. in-house.
  103.  
  104. c)    Only one 30 day trial is permitted per person.  You may not apply for 
  105. another trial.
  106.  
  107. d)    An Internet connection is required to access the Trial Edition.
  108.  
  109. e)    Except where in conflict with the clauses in this section 3, clauses 
  110. 2(e), (f), (g), (h) and (i) apply to the Trial Edition.  Where in conflict, 
  111. clauses from this clause 3 shall take precedence over such clauses in clause 
  112. 2.
  113.  
  114. 4.    THE LICENSED EDITION
  115.  
  116. a)    You may upgrade from the Free Edition by paying a fee.  There are 
  117. seven classes of license available, Small Business Edition, Professional 
  118. Single User, Professional Multi User ("Professional"); Educational Single 
  119. User, Educational Multi User, Student Teacher and Educational K-12 Pack 
  120. ("Educational").  The following conditions set out in this Clause 4 shall, 
  121. other than as expressly stated in Clause 4(c), (d), (h), (i), (j), (k) and 
  122. (l) apply to all seven classes of license available.
  123.  
  124. b)    Upon purchase of a license from any of the above license classes, you  
  125. will be sent a key to license the Free Edition ("Licensing Key"), which will 
  126. remove the Script Limits by installing the Licensing Key into the 
  127. "license.rev" file ("License File"), causing the Revolution software to 
  128. become fully functional ("Licensed Edition").
  129.  
  130. c)    If you have purchased a Small Business Single User License, Student 
  131. Teacher Educational License, Educational Single User License or Professional 
  132. Single User License, the Licensed Edition must be used exclusively by a 
  133. single individual, named on the license form ("Licensed User" and  "Licensed 
  134. Contact").  The Licensed User can be changed on completion of a license 
  135. transfer form, payment of a nominal fee and installation of a new Licensing 
  136. Key.
  137.  
  138. d)    If you have purchased an Educational Multi User License, Professional 
  139. Multi User License, or Educational K-12 Pack, you must nominate a single 
  140. individual as a contact ("License Contact").  Other individuals, who do not 
  141. have to be named, may use copies of the Licensed Edition, up to the maximum 
  142. number of users purchased with your license, each known as ("Licensed 
  143. User").  At no time may more individuals use the Licensed Edition than the 
  144. number of copies purchased with the license.  The License Contact is 
  145. responsible for enforcing this restriction
  146.  
  147. e)    The Licensed User may use the Licensed Edition subject to the same 
  148. conditions as set out in Clause 2 above, with the exceptions listed in parts 
  149. of this Clause 4 below.
  150.  
  151. f)    The Licensed User may use the Revolution Software without the Script 
  152. Limits imposed on the Free Edition.
  153.  
  154. g)    The Licensed User must not permit any other person to access the 
  155. Licensing Key or License File. 
  156.  
  157. h)    If you have purchased a Small Business License or a Professional 
  158. license, the Licensed Edition may be used by the Licensed User to produce 
  159. Created Software, as per 1. (b) above.  Such Created Software is subject to 
  160. all the restrictions on distribution of software created using the Free 
  161. Edition.
  162.  
  163. i)    If you have purchased any Educational license, the Licensed Edition 
  164. must be used for Educational purposes only.  If a K-12 Pack license has been 
  165. purchased, the Licensed Edition may only be used in educating those in 
  166. pre-school, primary and secondary education (UK), i.e. K-12 (USA), or local 
  167. equivalent educational age group, and by those in charge of such education, 
  168. solely for the purposes of furthering such education. If you have purchased 
  169. a student teacher edition you must be a student, under 18, or a K-12 
  170. teacher.  The Licensed Edition may be used by the Licensed User to 
  171. distribute Created Software, as per 1. (b), however such software cannot be 
  172. sold for any kind of profit.  No kind of contract or consulting work for 
  173. profit may be done with the Licensed Edition.  You may upgrade to a 
  174. professional license at any time by paying the difference in price between 
  175. an Educational License and a professional license.  If you are found to be 
  176. in breach of this clause 3 (I), you agree that you will immediately be 
  177. liable for the cost of upgrading to a professional license at prices current 
  178. as of the date the breach was discovered, plus a 10% administration charge.  
  179. Runtime Revolution Limited will be entitled to invoice and collect this 
  180. amount without further agreement.
  181.  
  182. j)    All license types include any updates to the Revolution Software that 
  183. are produced may be provided to the Licensed User free of charge for a 
  184. period of one year after the date of purchase but Runtime Revolution Limited 
  185. is not obliged at any time to produce updates during this period.  However, 
  186. if such updates are produced, the technical support obligation (if 
  187. applicable to the license type) listed in (k) below will only apply to such 
  188. updated version.  The Licensed User is responsible for the cost of updating 
  189. the Revolution Software, such updates will be made available via the 
  190. Internet.
  191.  
  192. k)    If you have purchase any license except the Small Business or Student 
  193. Teacher, Runtime Revolution Limited will provide technical support via email 
  194. to the License Contact for a period of one year after date of purchase.  
  195. Such support will be provided via a subscription to an email discussion 
  196. list, and a support contact email address at Runtime Revolution Limited.  
  197. You may use both addresses for support, but agree to make reasonable effort 
  198. to contact the correct address dependant on the type of question being 
  199. asked.  Guidelines on this subject may be found on our web site.  Support 
  200. will cover learning to use the Revolution Software, and issues relevant to 
  201. using the Revolution Software.  Such support will not be available during 
  202. reasonable holiday periods.  Runtime Revolution Limited reserves the right 
  203. to limit such support to a reasonable level, and is particularly likely to 
  204. limit support on questions covering aspects of designing software 
  205. applications.  Telephone support is expressly excluded. If a multi user 
  206. license has been purchased, the License Contact is expected to review the 
  207. support requests, handle simple and site specific problems, and pass the 
  208. remainder on to Runtime Revolution Limited technical support.
  209.  
  210. l)     If you have purchased a Small Business, Student Teacher or K-12 
  211. license, the Database Limits listed in 1 (c) will not be lifted.
  212.  
  213. 5.    TITLE
  214.  
  215. a)    Title, ownership, rights, and intellectual property rights in and to 
  216. the Revolution Software and all related documentation shall remain with 
  217. Runtime Revolution Limited. The Revolution Software is protected by the 
  218. copyright laws of the United Kingdom and international copyright treaties.  
  219. Portions of the Revolution Software are the copyright of MetaCard 
  220. Corporation, and are protected by the copyright laws of the United States 
  221. and international copyright treaties.  For the purposes of this license 
  222. "intellectual property rights" means any and all patents, copyright, 
  223. registered or unregistered design rights, trade marks, trade names, 
  224. know-how, database rights or other intellectual property rights.
  225.  
  226. 6.    DISCLAIMER OF WARRANTY
  227.  
  228. a)    THE TOTAL LIABILITY WHICH RUNTIME REVOLUTION LIMITED OWES TO YOU IN 
  229. RESPECT OF BREACH OF CONTRACT, NEGLIGENCE OR OTHERWISE SHALL, OTHER THAN IN 
  230. CIRCUMSTANCES IN WHICH SUCH ACTS RESULT IN DEATH OR PERSONAL INJURY IN WHICH 
  231. CASE LIABILITY SHALL BE UNLIMITED, BE LIMITED TO THE SUM OF £1000 IN RESPECT 
  232. OF ANY ONE CLAIM OR AGGREGATE OF CLAIMS ARISING IN ANY TWELVE MONTH PERIOD;
  233.  
  234. b)    THE SOFTWARE AND DOCUMENTATION ARE PROVIDED AS IS WITHOUT WARRANTY OF 
  235. ANY KIND.  TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUNTIME 
  236. REVOLUTION LIMITED FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT 
  237. LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A 
  238. PARTICULAR PURPOSE, AND NONINFRINGEMENT OF ANY THIRD PARTY INTELLECTUAL 
  239. PROPERTY RIGHTS;
  240.  
  241. c)    THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE 
  242. AND DOCUMENTATION REMAINS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY 
  243. APPLICABLE LAW, IN NO EVENT SHALL RUNTIME REVOLUTION LIMITED  BE LIABLE FOR 
  244. ANY CONSEQUENTIAL, INCIDENTAL, DIRECT,  INDIRECT, SPECIAL, PUNITIVE, OR 
  245. OTHER  DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS 
  246. OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR 
  247. OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR 
  248. INABILITY TO USE THE PRODUCT, EVEN IF RUNTIME REVOLUTION LIMITED HAS BEEN 
  249. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES;

  251.  
  252. 7.    TERMINATION
  253.  
  254. a)    This license shall terminate automatically if you fail to comply with 
  255. the limitations described in this Agreement.   No notice shall be required 
  256. from Runtime Revolution Limited to effectuate such termination.  On 
  257. termination you must destroy all copies of the Revolution Software including 
  258. the installer archive and any copies of it therewith.  However, such 
  259. termination does not prejudice the right of Runtime Revolution Limited to 
  260. obtain injunctive, equitable or any other relief in the event of such a 
  261. breach.
  262.  
  263. 8.    GOVERNING LAW
  264.  
  265. a)    This License shall be governed by the laws of Scotland, UK.  and in 
  266. the event of any dispute the parties agree to submit to the non-exclusive 
  267. jurisdiction of the Scottish courts.
  268.  
  269. 9.    ENTIRE AGREEMENT
  270.  
  271. a)    This License constitutes the entire agreement between Runtime 
  272. Revolution Limited and you with respect to the subject matter hereof and 
  273. with the exception of any fraudulent or negligent misrepresentations 
  274. supersedes all prior oral or written understandings, communications or 
  275. agreements not specifically incorporated herein.  The only exception to this 
  276. is any explicit terms you may have agreed to before downloading the package 
  277. from our web site, or any other supplementary terms made clear by us prior 
  278. to your agreeing to this agreement.  any such terms will form part of this 
  279. agreement.  This License may not be modified except in a writing duly signed 
  280. by an authorized representative of Runtime Revolution Limited and you.
  281.  
  282. APPENDIX A - Required Copyright Notice
  283.  
  284. You must include the following copyright notice where other such notices 
  285. appear.  In the event that  such other notices do not appear in the Created 
  286. Software, this notice must be placed in a reasonable location.
  287.
